Window to the Law: Adopting a Social Media Policy

NAR highlights why brokerages need a social media policy to ensure legal compliance, protect reputations and uphold ethical standards online.

CHICAGO — A written social media policy sets expectations for how agents and team members use social platforms while protecting the brokerage from legal exposure and reputational harm. In a recent video, the National Association of Realtors® (NAR) highlighted why every brokerage needs a clear social media policy.

NAR suggests requiring all posts to follow federal, state and local laws, including advertising, fair housing and antitrust rules. Specify any details required in online ads, such as the brokerage name, license number or state of licensure. The video also stresses banning unauthorized use of third-party content – images, music or videos – due to copyright infringement.

NAR further reminds Realtors® of their Code of Ethics obligations and to ensure that all online activity reflects both legal requirements and the standards of the profession. Because social media changes quickly, NAR recommends reviewing and updating a policy at least once a year.
