As a voluntary participant in an activity or event organized by Florida Association of Realtors® dba Florida Realtors® (“Florida Realtors®”), a Florida Not-For-Profit corporation, located at 7025 Augusta National Drive, Orlando, Florida, 32822, and/or as an attendee or user of the property, facilities and services of Florida Realtors®, 

As the “Participant”, I agree to the following: 
  
1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and to follow any oral instructions or directions given by Florida Realtors®, or the host location. 

COVID-19 SAFETY INFORMATION:
While attending an onsite or offsite event, I agree to strictly adhere to all current Centers for Disease Control (CDC) guidelines for COVID-19 (https://www.cdc.gov/coronavirus/2019-nCoV/index.html), and/or preventative measures put in place to reduce the spread of COVID-19. Florida Realtors® cannot guarantee that you will not become infected with COVID-19.

2. CERTIFICATION
By attending a Florida Realtors® event, you certify that you have not been exposed to a confirmed or suspected case of COVID-19 or have not been diagnosed with COVID-19, within fourteen (14) days of the event. Individuals who fall within the CDC definition of People at Increased Risk or People Who Need Extra Precautions for COVID-19 (https://www.cdc.gov/coronavirus/2019-ncov/need-extra-precautions/index.html), should seek medical clearance to attend the event or participate in the activity. 

By attending the activity or event each day, Participant warrants that he/she is not experiencing symptoms of COVID-19.  Common symptoms of COVID-19 can be found at https://www.cdc.gov/coronavirus/2019-ncov/symptoms-testing/symptoms.html. Participant agrees to contact Florida Realtors® if he/she experiences symptoms of COVID-19 within 14 days after participating in a Florida Realtors® event or activity.
  
3. INDEMNIFICATION. I agree to indemnify and defend Florida Realtors® against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon, the facilities of Florida Realtors® or the host location. 

  4. ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement. 
  
5. DISPUTE RESOLUTION. This Agreement shall be construed and controlled by the laws of the State of Florida.  The parties will attempt to resolve any dispute arising out of or relating to this Agreement through negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the Alternative Dispute Resolution procedure. 
  
Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction. 
 
6. RELEASE AND WAIVER. 
I HEREBY WILLINGLY, FREE FROM DURESS, RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST FLORIDA REALTORS® AND ITS AFFILIATED PARTNERS AND SPONSORS, INCLUDING IN EACH CASE, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS (THE “RELEASED PARTIES”), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF  THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION WITH THE EVENT OR ACTIVITY.

7 ASSUMPTION OF THE RISK. I acknowledge and understand the following:
Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While following rules and personal discipline may reduce this risk, the risk of serious illness and death is not completely eliminated. I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault associated with the event or activity, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of The Released Parties.

STATEMENT OF APPROPRIATE EVENT CONDUCT

Florida Realtors® is committed to providing a positive and rewarding experience for everyone associated with a Florida Realtors® event. All attendees (including without limitation Florida Realtors® members, guests, speakers, exhibitors, and vendors) are expected to conduct themselves professionally, to use good judgment and be respectful at all times while present at a Florida Realtors® event. This includes an attendee’s conduct while physically present at a Florida Realtors® event, as well an attendee’s conduct on any virtual platform associated a Florida Realtors® event.

HARASSMENT:
Florida Realtors® will not tolerate inappropriate behavior, including harassment or discrimination in any form of its members, staff, service providers, speakers, and event participants, based on an individual’s race, color, religion, sex, gender, pregnancy, sexual orientation, gender identity and/or expression, age, national origin, ancestry, physical or mental disability, marital status, military or veteran status, and any other characteristic protected by applicable law. Prohibited harassment includes all unwelcome behavior based on a protected characteristic where the purpose or effect of the behavior is to create a hostile, abusive or intimidating environment, or where the behavior otherwise adversely affects an individual’s ability to participate in or at Florida Realtors® related activities, or adversely affects a Florida Realtors® staff member’s employment in violation of this Statement. Harassment may be direct – against the target of the inappropriate behavior, or indirect – against a person who witnesses the inappropriate behavior. Prohibited harassment may take various forms, including, but not limited to, the following examples:

  - Verbal conduct, such as epithets, derogatory comments, slurs, or jokes, or unwanted sexual advances, solicitations, or comments.
  - Visual conduct, such as derogatory or sexually oriented posters, cartoons, drawings, or gestures.
  - Physical conduct, such as assault, impeding, or blocking movement.
  - Via technology or computers, including to transmit, communicate or receive derogatory, inappropriate pornographic, sexually suggestive, or explicit pictures, cartoons, messages, jokes, or material.
  - Threats and demands.
  - Requests for sexual favors, such as unwanted sexual advances, which condition a benefit upon an exchange of sexual favors.
  - Violence or threats of violence.

SEXUAL HARASSMENT:
Sexual harassment is one form of prohibited harassment. Sexual harassment includes but is not limited to 1) unwelcome sexual advances and other unwelcome verbal, visual or physical conduct of a sexual nature, or 2) requests for sexual favors or conduct of a sexual nature when (a) submission to or rejection of such advances, requests, or conduct is made either explicitly or implicitly a term or condition of membership, a benefit associated with membership, or employment; (b) an individual’s submission to or rejection of such conduct is used as a basis for a decision affecting that individual; or (c) the purpose or the effect of such conduct is to substantially interfere with the affected individual’s membership or employment or to create an intimidating, hostile or offensive work environment; or 3) sexual misconduct, which means any behavior of a sexual nature which also involves coercion, abuse of authority, or misuse of an individual’s leadership position.
Harassing conduct, including sexually harassing conduct, can be committed by a person of either the same sex or gender, or the opposite sex or gender (or any other protected category) of the person subjected to the harassment. A person may be the victim of harassment even though the offensive conduct has not been directed at the person alleging harassment, regardless of the sex, gender, gender identity, gender expression, sexual orientation, or other class status of the perpetrator.

The following are examples, but do not represent an inclusive list of conduct that may constitute prohibited sexual harassment:

- Unwelcome sexual flirtations or propositions.
- Unwanted physical touching or closeness, such as massaging a person’s back, neck or shoulders, hugging, kissing, patting, pinching, fondling, or touching/pulling an individual’s clothing or hair.
- Physical gestures that imply a sexual act or sexual anatomy, touching oneself in a sexual nature.
- Using vulgar words of a sexual nature, describing body parts, or sexual acts.
- Discussions or inquiries about sexual fantasy, preferences, history, or sex life about self or others.
- Displaying sexually suggestive or demeaning objects, pictures or cartoons, or other materials on a personal or company-owned device shared in the workplace.
- Giving personal gifts that imply an intimate relationship.
- Repeated invitations and/or pressuring/coercion for dates or sexual favors; harassing phone calls, emails, texts, social media posts, or other communication.
- Any suggestion that an individual’s position, job security, project assignment, or the terms or conditions of employment depend at all on the submission to or rejection of requests for sexual favors or relations.

REPORTING AND CONSEQUENCES:
Any attendee should immediately report any behavior they believe in good-faith violates this Statement of Appropriate Event Conduct to Juana Watkins, General Counsel (juanaw@floridarealtors.org). Please include as much detail as possible, such as the date, time, location, and a description of the incident being reported. Any attendee who believes they are in immediate danger should report the incident directly to the police via 911. Florida Realtors® reserves the right to take any necessary and appropriate action against any attendee who violates this Statement of Appropriate Event Conduct, including, but not limited to, immediate removal from the event (without a refund), prohibition from attendance at future Florida Realtors® events, removal from a committee appointment, and appropriate actions against membership.

ACCEPTANCE:

If registrant cannot participate, the full amount paid by registrant may be refunded only if written cancellation is received by Florida Realtors on or before January 26, 2026. No refunds will be made for cancellations received after January 26, 2026. Notice to Florida Realtors may be sent via email to meetings@floridarealtors.org. Presentation of this event may be postponed, rescheduled or cancelled. If such action is taken, registrants will be notified by e-mail and will receive a full refund of paid tuition/registration fees.
