Treasury proposes rules for large home investors
Treasury proposed rules outlining exceptions to federal limits on large investors’ home purchases. The law’s restrictions begin Jan. 7, 2027.
New federal limits on large investors’ single-family home purchases are approaching, and the Treasury Department is proposing details on which transactions could qualify for exceptions.
The proposal, announced Oct. 22, would implement provisions of the 21st Century ROAD to Housing Act. According to Treasury, the law generally bars covered investors from buying or signing contracts to buy single-family homes beginning Jan. 7, 2027, unless an exception applies. The implementation rules are still proposed.
The distinction matters for buyers and sellers weighing future transactions: Congress has enacted the restrictions, but Treasury’s proposed standards could change before becoming final.
The law’s definition of a large institutional investor includes entities with direct or indirect investment control over at least 350 single-family homes, along with other conditions.
Exceptions allow certain purchases through programs that build rental homes, renovate existing properties or support homeownership. Treasury’s proposal would establish standards for those programs, including substantial rehabilitation and financial support for renters buying homes. It also addresses renters’ rights of first refusal and 30-day first-look periods.
Treasury is accepting public comments for 30 days after the proposal’s publication in the Federal Register. The announcement gives no date for issuing final regulations.
Closing the comment period won’t automatically make the proposal final. Under the federal rulemaking process, the agency must consider public feedback and address significant comments, potentially revising its approach.
A final rule would then be published in the Federal Register with an effective date. Generally, rules take effect at least 30 days after publication, although exceptions can apply. Until Treasury completes that process, the proposed details remain subject to revision.
